1. Acceptance of Terms

By accessing and using VocaScript, you accept and agree to be bound by the terms and provision of this agreement.

2. Description of Service

VocaScript is an AI-powered transcription service provided "as is". We provide transcription services for audio and video files. The service relies on artificial intelligence technologies that may produce errors, omissions, or inaccuracies.

3. Usage Limits

To ensure fair usage for all users, we enforce the following limits:

• Processing Time & Size: We enforce reasonable limits on file size, duration, and processing time to ensure fair usage.
• Rate Limits: We enforce hourly limits on the number of uploads and transcriptions.
• Storage: We reserve the right to delete old or inactive files to manage storage costs.
• Changes: All limits are subject to change without notice.

4. User Content

You retain all rights and ownership of your content. We claim no intellectual property rights over the material you provide to the Service. You are responsible for ensuring you have the right to transcribe the content you upload.

You acknowledge that AI-generated transcripts may be inaccurate. You are solely responsible for reviewing and verifying all output before relying on it, especially for critical use cases.

5. Operational Data

To operate and protect the Service, we process limited operational metadata related to media requests and processing events, in line with our Privacy Policy.

6. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. We expressly disclaim all warranties of any kind, whether express or implied.

We do not guarantee that the service will be uninterrupted, timely, secure, or error-free. The Service utilizes Artificial Intelligence which may produce content that is incorrect, offensive, or otherwise not an accurate reflection of the source media. You are responsible for verifying all output.

7. Termination

By You: You may terminate your account at any time by selecting "Delete Account" from your account menu. This will permanently remove your profile, data, and access to the service.

By Us: We reserve the right to terminate or suspend access to our service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms or for periods of prolonged inactivity.

8. Paid Plans & Billing

VocaScript offers optional paid subscription plans with enhanced features and higher usage limits. By subscribing to a paid plan, you agree to the following:

Our order process is conducted by our online payment partner, who acts as the Merchant of Record for all our orders. The Merchant of Record handles customer billing inquiries and returns.

• Billing: Paid plans are billed on a monthly or annual recurring basis. Payments are processed by our Merchant of Record, who handles all transactions.
• Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
• Price Changes: We reserve the right to change subscription prices with 30 days' advance notice. Existing subscriptions will honour the current price until the next renewal.
• Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until then.
• Usage Limits: Each plan has defined limits on transcription time, storage, and features. Exceeding these limits may result in temporary restriction of service until the next billing cycle or plan upgrade.

9. Refund Policy

We want you to be satisfied with VocaScript. The same rules are published on our dedicated Refund Policy page (helpful for checkout and payment partners). Summary:

• 14-Day Money-Back Guarantee: If you are unsatisfied with your paid plan, you may request a full refund within 14 days of your first purchase. This guarantee applies once per account and does not reset on renewal.
• After 14 Days: Subscriptions are non-refundable after the 14-day window. You may cancel at any time to prevent future charges, and you will retain access until the end of your current billing period.
• How to Request a Refund: Contact us through the Contact page or at support@vocascript.com with your account email and reason for the request. You may also use links in your purchase receipt from our payment processor to manage or cancel the subscription or request a refund under their buyer terms. Approved refunds are typically processed within 5–10 business days via the original payment method.
• Exceptions: Refunds are not available for accounts terminated due to violations of these Terms of Service.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the service.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Morocco. For payment-related matters, the buyer terms of our Merchant of Record apply.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
